The Products are provided by SIWAVE-MS-HUB CYPRUS LTD, a Limited Liability Company incorporated under the laws of the Republic of Cyprus, with registration number HE474354, having its registered office at Persefonis, 7, Pervolia, 7560, Larnaca, Cyprus (“us”, “we”, or “our”).
Please read these Terms and Conditions (“Terms” or “T&C”) carefully before using our Websites https://siwave-ms.com/ and https://www.siwave-ms.net or placing an order with us. If you do not agree to all the Terms of this agreement, then you may not access our Website or use any of our Services.
The Users of our Services shall be referred to as “You”, “Your”, or “Users”.
In using our Website and/or placing an order with us, You are deemed to have read and agreed to the following Terms and Conditions set forth herein.
1. ELIGIBILITY OF THE USER
1.1.You may use the Service only if You are at least 18 years of age and can form a binding contract with Us, and only in compliance with these Terms and all applicable laws and regulations.
1.2.We reserve the right to refuse to offer our Services to any unauthorised Users.
2. PURCHASES
2.1. If you choose to purchase any of the Products we offer (the “Purchase”), you may be asked to provide the following current, complete and accurate information to enable us to process your order and communicate with You as necessary:

2.2. Payment for Products must be made in full at the time of Purchase. By submitting your payment information, you represent and warrant that you are authorized to use the designated payment method and authorize us (or our third-party payment processors) to charge the full amount to your payment method. 2.3.All prices for our Products are stated in EURO (€) and are inclusive of Value Added Tax (VAT), where applicable, in accordance with the applicable tax laws. The total amount payable, including any applicable taxes, will be clearly indicated at the time of purchase.
2.4.If you purchase a Product that later becomes unavailable, we reserve the right to cancel the agreement. In such case, we will notify you promptly of the unavailability and issue a full refund within 14 days.
2.5.We reserve the right to refuse any order you place with us.
2.6.We reserve the right to limit or prohibit orders that, in our sole judgement, appear to be placed by unauthorised dealers, resellers or distributors.
3. SHIPPING INFORMATION
3.1.Shipping will take place within 12 (twelve) working days after full payment has been received, provided the Product is in stock. If the Product is not in stock at the time of payment, You will be informed prior to placing the order, and shipping will take place within 4 (four) weeks from the date of payment.
3.2.Delivery times may vary depending on the destination and availability of the Products. While we make every effort to ensure timely delivery, we shall not be held liable for any delays caused by external factors beyond our control, including but not limited to customs clearance procedures, transport disruptions, or force majeure events.
3.3.Shipping costs are calculated during checkout on your online purchases, or if an order is placed through other means, the shipping cost, if any, will be provided in advance. Any customs duties, import taxes, or other charges imposed by local authorities for international deliveries shall be borne by You.
3.4.We are not responsible for lost or stolen packages. In the event that your package is noted as delivered and You have not received it, You are responsible for contacting the shipping carrier with the tracking information to obtain more information or to file a claim. We shall not be liable for any loss or delay resulting from incorrect or incomplete shipping information.

4. RETURNS & WITHDRAWAL POLICY
4.1. In your online or on-premises purchases, You have the right to cancel or return your order within 14 days, for any reason without a justification. The Products must be in the same condition that You received them, unused, with tags if any, and in its original packaging.
4.2.The withdrawal period expires 14 days from the day after the day on which You acquire, or a third party designated by You – other than the carrier of SIWAVE-MS-HUB CYPRUS LTD – acquires, physical possession of the Products.
4.3. To exercise the right of withdrawal, You must inform us of your decision to withdraw from the agreement by a clear written statement sent to info@siwave-ms.net.
4.4.If You withdraw from the agreement, we will reimburse to You all payments received from You, including the cost of delivery (except for any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us), without undue delay and in any event no later than 14 days from the day on which we are informed of your decision to withdraw.
4.5.We will carry out such reimbursement using the same means of payment You used for the original transaction, unless you have expressly agreed otherwise. No fees will be charged to You for this reimbursement. We may withhold reimbursement until we have received the goods back or You have supplied evidence of having sent them back, whichever is earlier.
4.6.You will only be liable for the direct costs of returning the Products.
5. DEFECT WARRANTEE AND LIABILITY
5.1. All Services purchased by us are covered by a guarantee period of 24 months from the date of you receive the Product, in accordance with applicable EU consumer protection laws.
5.2.To submit a warrantee claim, the Products must be returned directly to us. The warrantee applies to defects that arise during the warrantee period and are demonstrably caused by faulty materials or manufacturing defects.
5.3. At our discretion, we may remedy a valid warrantee claim by repairing or replacing the goods at no cost, or refunding the purchase price.
5.4.Further claims by You shall be excluded. In particular, we shall not be liable for faults/ damages attributable to accidents, neglect, misuse, improper installation or improper use, natural wear, or for damages which do not arise in the object of the delivery itself (consequential harm caused by a defect). Any modifications or repair work performed without our consent or the written consent of the manufacturer as well as failure to adhere to the T&C shall abrogate the warrantee liability.
6. PRODUCT USE & USER MANUAL
6.1.All products must be used strictly in accordance with their intended purpose and the instructions provided in the official user manual which is uploaded on our Website.
6.2.It is Your responsibility to consult the manual prior to using the product to ensure proper handling, installation, maintenance, and safety.
6.3.We shall not be held liable for any damage, malfunction, or injury resulting from misuse, incorrect installation, or failure to follow the instructions and guidelines outlined in the manual.
6.4.If you have any questions regarding the content of the manual or the proper use of the product, please contact our support team before using the products.
7. LIMITATION OF LIABILITY
7.1.You acknowledge and agree that we are not the manufacturer of the Products.
7.2.We shall not be liable for any defects in the Products that were not visible or identifiable at the time of delivery or upon reasonable inspection, or for defects that arise due to the actions of third parties after the transfer of the Products.
7.3.We shall not be held liable for any damages or injuries arising from a Product defect unless the defect was caused by our own negligence, willful misconduct, or failure to comply with the instructions provided by the manufacturer.
7.4.Nothing in these Terms shall operate to exclude or limit any liability which cannot be excluded or limited under applicable law, including liability for death or personal injury caused by our negligence.
7.5.Our total liability under or in connection with these Terms shall in no event exceed the amount paid by You for the Product giving rise to the claim.
8. DATA PROTECTION
8.1. We strive to protect the privacy and the confidentiality of personal data we collect and process in connection with the services we provide to You. Thus, we undertake to meet our obligation under the General Data Protection Regulation (EU) 2016/679 (“GDPR”) and the Cyprus Law on the Protection of Natural Persons with Regard to the Processing of Personal Data and on the Free Movement of Such Data (Law 125(I)/2018).
8.2.We collect and process personal data strictly for the purpose of performing our contractual obligations, processing orders, providing customer support, complying with our legal obligations, and, where applicable, with your consent for marketing or communication purposes.

9.1.SEVERABILITY: In the event any provision of these Terms is determined to be void or unenforceable, such determination shall not affect the remainder of the Terms, which shall continue to be in force.
9.2.ENTIRE AGREEMENT: These Terms constitute the entire agreement between You and us with respect to the subject matters contained herein and supersedes all prior agreements, understandings and negotiations between us.
9.3.GOVERNING LAW & JURISDICTION: These Terms shall be governed by and construed in accordance with the laws of Cyprus. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of the Republic of Cyprus.
9.4.CHANGES TO TERMS: We reserve the right, at our sole discretion, to update, change or replace any part of these Terms by posting updates and changes to our Website. It is your responsibility to check our website periodically for changes.
9.5.AFTER SALES SUPPORT: We are committed to providing quality after-sales support to assist you with any issues, inquiries, or guidance related to the use of our products and services.
